Extra Fees

Complexity fees may be added based on the “complexity” of a client’s character design. Complex character design can include: asymmetrical patterns, lots of color variation, spots, stripes, accessories, ect.Lined starts at $25

Printing and lamination fees will be charged if the client wishes for a badge or other artwork to be printed and laminated. Fees are subject to change with the complexity of the request.Starting at +$10

Terms of Service

Artist and Client AgreementFor the remainder of the document "commission" shall refer to the agreement between an artist and a client where cash or goods are exchanged for art created by the artist, Percy McKay.By commissioning the client agrees to the following terms.Artist ObligationsThe artist, Percy McKay, will complete the following work for the client within the stated deadline and to the clients satisfaction.Note, the artist reserves the right to limit the amount of prerequisite sketches as well as watermark work in progress images. The artist will keep the client informed about the progress of their artwork and will provide progress images as they come about or upon specific dates agreed upon between client and artist.If the client wishes for the artist to complete any artwork or responsibilities not stated within this document, the client is subject to any extra fees that may come with the extra services.Client ObligationsThe client has agreed to compensate the artist with the appropriate payment as stated and adhere to the following Terms of Service.While not required, for the sake of efficiency and client satisfaction, the artist requests reference images for the clients vision.Examples:Images for poses, backgrounds, expressions, clothing, ect.
Images can be stock photos, personal photos, or anything that conveys the idea the client wishes to be created.
3D Renders
The client may provide 3D renders at any point of any background, prop, or character.
Color Palettes
Images that convey the desired colors for the piece or pieces.
Detailed writing describing the desired outcome.
NOTE: The artist will allow the client to provide artwork created by other artists as reference images, however, the artist WILL NOT mimic or reproduce in any fashion the provided artworks. The artist will take inspiration for color, mood, and posing, but will not mimic the style, scene, or overall composition of any provided works. The client agrees to respond in a timely manner or communicate if there is to be any delays in communication.
If the client is unresponsive for a period of one month since last contact with no notice, the artist reserves the right to cancel the commission in its entirety.
For the sake of documentation commission details will never be discussed verbally in person or over a voice/phone call. Text format will be the only method of communication.MaterialsIf the commission is done through “traditional” methods (I.E: watercolors on paper, acrylic paint on canvas, ect) the artist will charge an additional fee depending on the cost of the materials required.The artist has the obligation to be open and clear about material costs and provide a quote for the estimated costs.Materials can be and are not limited to:Paints

Shipping and DeliveryShipping for Traditional ArtIf the client and artist are attending the same convention– and/or event– in-person pickup is available for physical works such as original works, badges, ect.Convention pick up (or “con delivery”) are exempt from shipping costs, however the artist may charge extra fees regarding lamination, printing, ect. (Pricing can be found on the artist's website under Pricing and Examples.)The artist holds the right to refuse “con delivery” for any reason and offer alternatives or cancel shipping altogether.CostShipping cost is to be covered by the client and will be calculated in United States Dollars from the starting point in the US.The artist and client reserve the obligation to keep any shipping details confidential and limited between both parties.See Privacy Policy.Artist ObligationsThe artist is obligated to properly package any necessary art works to ensure a safe journey to the client. The artist is obligated to confirm any details regarding address, names, ect and have them properly transferred to the shipping label.The artist will communicate when the package has left their local post office and keep updates with the client with the arrival of the package.The artist is not reliable for any damages caused by shipping or any lost or stolen packages.Client ObligationsThe client is to provide information for any shipping as accurately as possible. The artist is not responsible if the package is delivered to the wrong address, missing, or unable to be delivered and has to be returned due to incorrect information provided, the client is responsible for any fees or new shipping costs that may occur. The client is obligated to update the artist on whether the package has arrived.ReimbursementThe client has 12 hours since pick up to inform the artist of any damages caused by improper packaging or any damages that could otherwise be determined to be at fault of the artist.The client must provide photo or video evidence of the damage.The client may be entitled to a new piece free of charge or a reimbursement of up to 50% of the total amount paid to the artist. Reimbursement will be discussed with the artist and calculated based on the damage amount.Delivery of Digital ArtDigital art may be sent through the approved communication methods in Artist and Client Agreement and digital works will be sent as a .png file.Throughout the work in progress (WIP) stages the artist will use low quality watermarked images to show progress.QueueThe artist works in a slot based queue system which is first come first serve with few exceptions.The artist has 5 slots of active commissions they will be working on. Once the queue slots are full the artist will no longer take new commissions until the current queue is finished.Deadlines are determined chronologically unless a deadline is given.A queue will be publicly available through the service of Trello and a link will be provided at the bottom of the artist's website.Privacy PolicyThe artist and client are both obligated to uphold each other's privacy and limit information to the artist and client.Both parties are obligated to not share information including but not limited to:IDs

Personal Social Media Accounts
Sharing information can include social media posts, group messages, ect.The artist only has one handle on BlueSky, Instagram, and Tumblr (@percycolondee)-- with the exception of discord (@OverInACorner). Any other account claiming to be the artist is fake unless stated by the artist through the aforementioned handles.All social medias will be linked on the artist's website.NSFWWhile the artist will take on NSFW (Not Safe For Work) commissions the artist REQUIRES proof of ID to prove the individual is 21+.Failure to provide ID will result in denial of the client's commission and they will be blacklisted.Copyright, Licensing, OwnershipThe artist keeps all copyright and licensing regarding the artwork and their “brand” in terms of marketing, merchandising, profit or any other sort of commercial use using the image created for the client.The artist also reserves full copyright, licensing, and ownership over their own original characters or designs that may or may not appear in artwork requested by the client.Once payment is completed the client holds ownership of the art and may use it for personal use in which the client does not make a profit. Such as: Stickers, printing on clothing, personal social media account profile pictures, printed fursuit badges, ect.In regards to reposting to personal social media accounts and other social media terms see Social Media.The artist holds the right to request a fee, royalties, or full removal of their artwork if they find it has been used for commercial use without prior agreement.Marketing, merchandising, and any other profit or commercial use is permissible if discussed with the artist and an agreement has been made regarding fees, royalties, or other payment.Merchandising includes but is not limited to:Stickers

Social MediaBy commissioning the client agrees to have their commission posted on the artist’s social media (@percycolondee), portfolio website, and use the artwork as commission examples. If the client does not agree they are to reach out to the artist directly and the artist will accommodate accordingly.The client agrees that if they post their commission to any social media they are to tag the artist and give proper credit for the creation of their commission or post a watermarked version that is available upon request.Failure to credit the artist or claim the image was created by the client may lead to a take down of the post and the potential to be blacklisted.Any commission that has gone through the proper commercial use procedure may be exempt.AI PolicyThe client will not use the artist’s work to train Artificial Intellegence ("AI").The client agrees they will not use AI to mimic, reproduce, or enhance artwork including sketches, finished pieces, ect. Failure to comply will result in being blacklisted.The artist will not use AI during any stage of the commission. This includes ideation, reference gathering, sketches, character designs, enhancement, ect.Payment and Refund PolicyPaymentPayment is due 100% up front and work will only begin once payment is fully recieved.Partial payments are permissable, please reach out to the artist for more information.Shipping fees may be owed at a later date separate from artwork completion once the full shipping cost has been calculated.The artist will send an invoice/request through the agreed upon payment methods.Payment will only be processed through cash (locals only), Venmo, or Paypal.Bartering
While the artist may be open to the trade of goods such as art, fursuit parts, ect. to lower the cost, the artist holds the right to refuse any trade offer given.
Refunds and CancellationsRefunds will not be issued for completed commissions.If a commission is cancelled the client will recieve a refund equal to the percentage left on their commission.For shipping refunds/reimbursement see Shipping and Delivery.
